Council approves $67,000 settlement for Crawfordsville Road right-of-way to avoid condemnation

The Speedway Town Council approved a settlement and release agreement on Oct. 27 to acquire permanent and temporary right-of-way from property owner Judy Thomas related to the Crawfordsville Road project.
Grant Kleinheinz said negotiations were intended to avoid a condemnation proceeding and that the agreement covers half an acre of permanent right-of-way and 0.009 acres of temporary easement for a settlement payment of $67,000, along with other release conditions prepared by town counsel. He said two remaining parcels owned by Brixmore remain under negotiation but this agreement would allow the contractor to resume work in that segment.
Kleinheinz asked the council to authorize the clerk-treasurer’s office to prepare a claim so payment could be issued within the required timeframe. Town attorney Ted Nolting and staff indicated an early access agreement was included so the contractor can begin affected work; Kleinheinz said the contractor had paused work in recent weeks pending resolution of property access.
The council voted 5–0 to approve the settlement and directed staff to prepare the claim for payment.
