Council denies short-term rental special use after staff finds subdivision covenants ban commercial uses

The Peoria City Council on Oct. 28 unanimously denied a special-use application to operate a short-term rental at 3806 West Thistle Lane after staff discovered recorded covenants that prohibit business or commercial uses in the Summer Ridge subdivision.
Assistant Director of Community Development Lee Allison told the council that planning staff and the city—s legal department reviewed the subdivision covenants after the planning and zoning commission meeting and concluded the covenants apply and bar short-term rental uses. Allison said staff therefore revised its recommendation from approval to denial.
Council member Cyr moved to deny the special-use application; the motion was seconded by Council member Allen and passed unanimously.
