The Burley Citizens Association appealed a February DOB permit that authorized installation of four 80‑foot lighting poles at a public recreation facility (permit B2308807). At the Oct. 29 hearing the appellant argued the installation raised neighborhood and zoning concerns; the Department of Buildings and the Department of General Services (the intervener, acting for the Department of Parks and Recreation) defended the permit.
Appellant Michael McDuffie said the association sought review of the Zoning Administrator’s interpretation that allowed the permit to proceed. DOB Assistant General Counsel Chris Harrison and the Zoning Administrator Kathleen Beaton responded; counsel for the intervenor, Meredith Moldenhauer of Cozen O’Connor, asked the board to strike a particular late exhibit from the record and defended the park agency’s procedural compliance.
The board deferred further action and continued the appeal to Dec. 10. Chair Fred Hill noted that the zoning commission was scheduled to consider an omnibus text amendment the following day that could affect the legal standards at issue, and the continuation gives the parties time to review any revision and to add filings to the record.
No final determination was made on the merits; the board directed parties to submit any supplemental legal briefs or evidence as needed ahead of the Dec. 10 continuation.
