The Kandiyohi County Drainage Authority on Aug. 19 approved a limited conflict waiver allowing Rinke Noonan to represent the Middle Fork of the Crow River Watershed District on a state-sponsored project to reconstruct outlet structures that affect County Ditch 20.
Meeting discussion noted the waiver is exclusive to this matter because the law firm also represents County Ditch 20 in other contexts. The chairman said Rinke Noonan’s work for both entities had occurred previously and that the county attorney did not object to the limited waiver.
Drainage staff reported elevated water levels on Green Lake and said aquatic vegetation, including wild rice, is growing in the channel of County Ditch 20 and appears to be slowing outflow. Staff said water is still flowing but that the vegetation could affect circulation until it dies back; they are consulting the Minnesota Department of Natural Resources about permitted options and possible DNR-led work.
The Drainage Authority approved the waiver by motion and voice vote. Staff said they would explore vegetation-cutting options and DNR permitting for potential work in the channel.
