Cache County updates garbage and county-attorney fee schedules; auditor and attorney ordinances passed

Cache County Council adopted two fee-schedule updates on Oct. 28 after public hearings: (1) Ordinance 2025-38, an auditor fee schedule update to pass Waste Management contract cost increases to users in unincorporated areas; and (2) Ordinance 2025-39, a county attorney fee schedule updating charges for discovery materials and related services.

Auditor presentation: Matt Funk explained the auditor's office bills users in unincorporated areas for residential refuse pickup under contract with Waste Management. Waste Management had increased its rates; the auditor's proposed schedule passes those contract increases to the affected customers. Funk said the county intends to update the fee schedule annually or as contract CPI changes warrant. The council suspended the rules and passed the auditor fee ordinance by unanimous voice vote.

County attorney presentation: County Attorney Taylor told the council the office had been absorbing the costs of producing discovery and electronic materials and proposed a fee schedule to recover those actual costs from parties who can pay; indigent defendants represented by the public defender would not be charged. Taylor said parties could bring their own physical media (sealed drives) to avoid a county-provided hard-drive charge. The council voted unanimously to suspend rules and adopt the attorney fee schedule ordinance.

Next steps: The auditor noted the Waste Management contract negotiations could produce additional changes and advised the council the fee schedules will be revisited with any new contract terms; staff recommended prompt action so the county does not continue to subsidize contract increases in the interim.

Votes: Both ordinances were passed after motions to suspend the rules and approve; vote records were unanimous in the meeting (voice votes).
