CARBONDALE — The Planning and Zoning Commission on Oct. 23 debated how ADU permitting should be reviewed: whether staff should be allowed to approve routine interior or small ADUs administratively or whether the commission should retain review authority for many types of ADUs.
Staff presented a range of review options: (A) administrative review for most ADUs (interior ADUs handled as building permits, others as administrative site plan); (B) more discretionary PNZ review for more ADU types; (C) a hybrid tiered approach with notification and limited neighbor input; and (D) a tiered system that included neighbor notification and public hearing triggers tied to complaints (a staff memo noted implementation issues with a complaint-driven trigger). Commissioners broadly supported a tiered approach but asked staff to replace complaint-based triggers with clear, objective thresholds (for example, square-foot thresholds, number of bedrooms, height or distance from the main building) that would require PNZ review. Several commissioners suggested simple numeric triggers — for instance, 1-bedroom or smaller ADUs under a stated square footage could be administrative reviews, while multi-bedroom ADUs or those exceeding specific size/height thresholds return to PNZ.
Commissioners and staff emphasized the need for clarity so applicants and neighbors understand when hearings will occur. Staff reiterated that special-use or conditional-use requirements in certain zones (for example, medium-density residential) currently trigger public hearings under the UDC. The commission asked staff to draft specific tiered thresholds and to design a straightforward notification mechanism for neighbors.
No changes to the review process were adopted at the meeting. The commission asked staff to prepare draft code text spelling out objective thresholds for administrative review vs. PNZ hearing and to include that text in the Nov. 13 continued hearing package.
