Developer updates Kilometers proposal: solar plus housing; council moves to executive session on sale

A development team asked Timnath Town Council on Oct. 28 to extend and update a previously approved sale agreement for the town-owned Kilometers property and described a revised mixed-use concept that combines utility-scale solar, potential battery storage and an affordable-housing component.
Bryce Vincent, representing Synovus, TRC Companies and Timnath Energy Services, said the team has moved from a pure solar-storage plan toward a mixed-use concept that retains utility-scale renewable energy while adding up to 250 affordable housing units and retail frontage along State Highway 14. Vincent described possible solar configurations ranging from about 10 megawatts up to roughly 25 megawatts; a 10-MW option could interconnect to the local distribution system while larger sizes would require substation interconnection. He also described options for pairing solar with battery storage and for community-solar programs in partnership with local electric providers.
“Solar range right now that we're looking at and talking with them about ranges from 10 megawatts up to 25 megawatts,” Vincent said during the presentation. He told council the team is working with multiple potential off-takers, naming rural electric associations and utilities as possibilities.
Vincent said the project timeline has been affected by federal incentive changes and other market constraints; the buyer's original diligence extensions have lapsed and the presenter requested the town consider revising the existing contract and extending the closing into 2026 so the team can continue land-use approvals and secure an energy off-take and financing. The developer also asked the town to support rezoning to business and agricultural mixed-use, to consider on-site wastewater treatment until regional sewer becomes available (the developer cited a 5–10 year timeline for connection to regional sewer), and to participate in discussions with the electric cooperative about community-solar options for Timnath residents and businesses.
Vincent said the team is discussing modular affordable housing approaches with TRC and had a letter of intent for roughly 250 units in Northern Colorado; he emphasized local construction and workforce use. He also described an on-site wastewater treatment package (vendor: EarthTech) as a near-term solution until a future Box Elder sewer extension is available.
Council asked technical and siting questions and deferred detailed legal and contract issues to executive session. Later in the meeting council voted to move into executive session under C.R.S. 24-6-402(4)(a) “for the purpose of discussing the proposed sale of any real personal or other property interest of the town concerning proposed sale of property commonly referred to as the Kilometers Farms or Kilometers North property.” Council later reconvened and adjourned; the public record does not show a post-session vote on the sale during the Oct. 28 meeting.
The developer presentation flagged several uncertainties: federal incentive rules for solar and batteries, the need to secure an energy off-taker or virtual power purchase agreement, and the timing and cost of wastewater and other public infrastructure. The team asked for council feedback and staff technical support to continue negotiations and land-use processing.
