Planning commission approves Geneva Street conditional use after adding fence and moving dumpster pad

The Opelika Planning Commission on Nov. 1 approved a conditional-use application for a mixed-use development on Geneva Street after adding two conditions requested by nearby residents: a six-foot slatted cedar (or comparable) fence and relocation of the dumpster pad toward Geneva Street.
Neighbors at the public hearing raised repeated concerns about stormwater and surface-water levels, nighttime lighting, the proximity of the dumpster to an adjacent lot and changes to backyard privacy. “The groundwater is close to the surface,” said Jessica Rosar, a Geneva Street resident, describing a cellar with a sump pump and saying that power failures can cause cascading failures of household systems.
The developer’s engineer, Josh Mira of Sanford Group, told the commission the team would consider relocating the dumpster and said the proposed landscaping follows code: “What the developer is trying to do is create the impervious buffer that is outlined in the code. We’re following the ordinances … having an evergreen or magnolia every 6 feet to create that impervious buffer.” He described a drainage plan that would direct some flows to Geneva Street storm infrastructure and the remainder to a bioretention pond.
During commissioner discussion, a motion to amend the staff recommendation added a requirement for a 6-foot slatted fence constructed of cedar (or comparable material) and moved the dumpster pad east toward Geneva Street to reduce truck traffic along the interior drive. The amendment was seconded and approved on a roll call vote.
The commission then voted on the conditional use as amended; the roll call tally was four in favor and three opposed, and the conditional use was approved as amended.
Staff will hold final signatures and approvals until outstanding submittals required for construction (including maintenance and performance bonds, as-built documents and other standard items) are provided. The approval includes the added fence and dumpster-location conditions; further infrastructure and permit work will be monitored by engineering and public-works staff ahead of final plat or building permit stages.
