The Speedway Redevelopment Commission voted Oct. 27 to approve a $5,000 settlement related to substandard concrete work at Pocket Park.
Economic Director Kyle Markley explained that Rigdon was the prime contractor and Abrams was a subcontractor who performed concrete work that did not meet contract standards. Rigdon removed Abrams and completed the project, but Abrams asserted payment was due. The parties entered mediation and the claim was settled with the town agreeing to pay $5,000; Rigdon will also contribute toward resolution, Markley said. "Long story short, we went through mediation. It was settled that we would pay $5,000 out," Markley said.
Markley told commissioners that town code enforcement and the building commissioner identified the defective work, had it torn out and replaced, and that the pocket park is now serviceable for events. A motion to approve the settlement was made and seconded; the commission approved the payment 5-0.
Why it matters: approving the settlement closes a dispute without additional litigation costs and allows the town to continue programming the pocket park for events.
