Lancaster County ad hoc committee holds closed session on Haven Development Agreement

The Lancaster County Council ad hoc development agreement committee convened and unanimously approved its meeting agenda and the minutes of its Oct. 13 meeting before voting to enter an executive session to receive legal advice about a potential contractual matter related to the Haven Development Agreement.

The committee chair called the meeting to order, noted a quorum and that the agenda and public notice had been posted in the County Administration Building lobby and on the county website. The chair asked for approval of the agenda; a motion and a second were recorded and the chair said the voice vote was 3-0 in favor. The committee then approved the Oct. 13 minutes by voice vote.

The chair moved that the committee go into executive session “for the receipt of legal advice subject to the attorney–client privilege regarding a potential contractual matter related to the Haven Development Agreement” and to invite the planning director and potential developer representatives into the session. The motion was seconded and approved by voice vote; the committee convened in closed session.

After the closed session the chair reconvened the open meeting. Jenny, a county staff member, read a for-the-record statement saying, “the ad hoc committee met in executive session in regards to 1 item, the receipt of legal advice subject to the attorney client privilege regarding a potential contractual matter related to the Haven development agreement. No motions were made. No votes were taken.” The committee then voted to adjourn.

The committee did not take any recorded actions on the substance of the Haven Development Agreement in open session. The meeting record shows procedural approvals (agenda and minutes), the authorized executive session for legal advice, a staff for-the-record report that no actions occurred in closed session, and adjournment.
