The court set a target return presentation of Jan. 29, 2026, and asked staff to seek a public hearing in March 2026 under Chapter 26 of the Texas Parks and Wildlife Code if the taking proceeds.
The item, which drew more than two hours of public testimony, centered on Harris Health’s request to pursue a purchase or condemnation of parkland immediately in front of Ben Taub’s emergency entrance to build an adjacent expansion that Harris Health says is the only operationally viable and fiscally responsible option to add roughly 100 inpatient beds and procedure areas.
Members of the Hermann Park Conservancy and frequent park users urged the court not to permit any taking without a full alternatives analysis, more transparent community engagement and assurances that compensation would be used to restore or improve parkland. "Hermann Park and Ben Taub are both vital public assets," said Kara Lambreight, identified in public comment as CEO of the Hermann Park Conservancy. "They should not be placed in opposition."
Ben Taub leaders and clinicians said the hospital is routinely operating above capacity and that the expansion is needed for patient safety. "We have patient beds placed in our hallways because we don't have any space," said Dr. Paul Klotman, identified in testimony as president and CEO of Baylor College of Medicine, who urged the court to consider the expansion to reduce emergency-room waits and avoid hallway care.
