Three zoning appeals scheduled for Oct. 29; staff preparing reports

Staff said three zoning appeals are tentatively scheduled for Oct. 29: an appeal of Planning Commission determinations from July 7, a variance request to the BZA for PDC language percentages, and an appeal of a zoning administrator's decision regarding Parcel B.
Kevin, the town planning staff member, told commissioners the town has three pending zoning appeals tentatively scheduled for Oct. 29 and that staff is preparing reports for each application.
He described the three items:
- An appeal of Planning Commission determinations made at the July 7 hearing, where a concept plan had been denied as inconsistent with town code. Kevin said the appeal focuses in part on recommendations the commission made at that hearing and on items noted in the staff report.
- A zoning-variance application to the Board of Zoning Appeals seeking modification of the required language percentages for the PDC (Planned Development Commercial) zoning district. Kevin said the applicant previously discussed this pathway and that the commission had recommended pursuing a text amendment in some earlier conversations; legal counsel is reviewing implications.
- An appeal of the zoning administrator's decision that Parcel B may not proceed without an updated concept and preliminary plan that reflects proposed changes to the approved plan. Kevin said the decision was made under the amendment section of the BEC section of the town code, which states amendments to an approved plan must go through concept, preliminary and final review steps; the applicant is appealing that enforcement.
Kevin emphasized staff is still drafting reports and will circulate public materials when ready. He also noted the hearings are recorded and likely to be long given three applications on one agenda; one commissioner said they might attend the evening session.
No formal action on any of the appeals was taken at the Oct. 6 meeting; staff said it will provide updates to the planning commission after the hearings.
