DuPage County panel asks state's attorney to clarify ICE signage after mixed legal interpretations

Members questioned whether signs at the DuPage County complex that refer to immigration enforcement "only with judicial warrant" accurately reflect the law, saying federal officers may act on probable cause or federal detainers.
During new business, members raised questions about signs posted at the county complex that read, according to a member—s photo shown in the meeting, "DuPage County property immigration enforcement only with judicial warrant." Member Zay said he worried the signs could mislead the public because federal officers could make arrests on probable cause or under federal detainers: "So those signs are correct or somewhat correct or I I mean, again, I don't want people thinking they can come to the county complex and feel like they're safe..." Member Zay later said directly, "But that's not correct. They would just hurt you. They can come for probable cause or for a federal, detainer. So that sign's not correct."
Member Garcia and others countered that the signs were intended to communicate a limit on immigration enforcement without a judicial warrant and said the chair worked with the state's attorney's office before posting the signs. "The wording is immigration enforcement only with judicial warrant. And, of course, that is what is actually happening," Member Garcia said, while acknowledging concerns about enforcement practices reported by constituents.
Vice Chair Eckhoff and other members asked the state's attorney's office to provide a legal opinion at the next meeting to determine whether the posted signs accurately reflect the law and, if not, whether they should be removed or revised. Mister McCarthy agreed to seek the requested clarification.
