Council adopts ordinance setting CFO standards for dues deduction and recognizing Progressive Firefighters of Atlanta

The Atlanta City Council adopted an ordinance on Nov. 3 directing the chief financial officer to develop administrative standards under which employee organizations may qualify for payroll deduction of member dues. The adopted substitute explicitly recognizes the Progressive Firefighters of Atlanta as eligible for dues deduction and preserves existing organizations’ eligibility.

The measure, coming to the floor after discussion in Finance & Executive Committee, was amended on the council floor to require that any employee organization demonstrate support of more than 50% of employees in its community of interest before qualifying. Law department attorneys explained to council that the provision is administrative: the ordinance tasks the CFO with drafting standards but preserves the council’s authority to act later. The city attorney also told members that an existing collective bargaining agreement for the firefighters is on the mayor’s desk awaiting signature, and that the ordinance does not contradict or invalidate negotiated agreements.

Union leaders from Progressive and other firefighter organizations addressed the council during public comment and committee hearings, asking for due-process protections and clarity so payroll deduction rules cannot be used to exclude organizations arbitrarily. The adopted ordinance includes a provision that the CFO must consult recognized employee organizations when drafting the standards.

After a motion to reconsider earlier committee adoption, council approved the substitute as amended. The final recorded vote on the ordinance as amended was 11 yeas, 0 nays. The ordinance delegates rule-making to the CFO but requires that recognized organizations and the Progressive Firefighters be explicitly listed as having access pending the administration’s promulgation of standards.
