Austin Hilliard McDuffie pleaded no contest to counts involving false name, address or date of birth in Clayton County State Court on Nov. 4, 2025. The court nol prossed the marijuana possession count and accepted no-contest pleas to the identity-related counts, then imposed concurrent 12-month terms with 30 days to serve and credit for time already served.
Defense counsel stipulated to a factual basis and the state recommended the concurrent one-year sentences with 30 days to serve and credit for time served. Judge Tammy Long Hayward accepted the plea and addressed McDuffie directly in a lengthy admonition about parental responsibilities, telling him, among other things, “Condoms are cheaper than child support or child care,” and urging him to seek stability for his children.
The judge suspended the balance of the sentence provided McDuffie commits no new law violations. The court recorded the plea and directed jail staff to apply credited time served toward the custodial component.
Clarifying details: the disposition included nol prossed possession count, guilty/no-contest to identity counts, 12 months with 30 days to serve (concurrent), credit for time served and suspension of the balance pending compliance.
