Board approves amendment to permit for existing 340-foot American Tower near Route 22

The Louisa County Board of Supervisors voted unanimously Nov. 3 to approve conditional use permit amendment CUP2025-08 to modify CUP1994-03 for an existing 340-foot telecommunications tower on Shopping Road (near Route 22).

Planning staff told the board the applicant seeks two changes: removal of condition 8that currently states the permit "is not transferable to another applicant or owner," and revision of condition 10 to replace a requirement that the tower be removed within 90 days of a violation with the county's current standard telecommunications enforcement language. Planning staff said the Planning Commission found the request to be in substantial accord with the countys 2040 comprehensive plan and recommended approval.

Valerie Long, an attorney with Williams Mullen representing the applicant, said American Tower (or an affiliate) is the tower operator and All For 1 LLC is the property owner. Long told the board the structure has existed for roughly 30 years and that corporate ownership of tower assets has changed over time, which the removal of a nontransferability clause would address. She also confirmed that a structural analysis was submitted to evaluate the towers capacity after Verizon sought to upgrade equipment; planning staff flagged the permit discrepancy when Verizon submitted its application.

No members of the public spoke during the hearing. After brief questions from supervisors about current carriers and the tower type, the board moved, seconded and approved the amendment without objection.

The action replaces the nontransferability language in CUP1994-03 and adopts the countys updated enforcement language for telecommunications towers; no changes to tower height or location were proposed.
