Council warned of pending wildland-urban interface rule changes under HB48; staff to brief Nov. 18 work session

Staff and council discussed proposed rulemaking under House Bill 48 requiring local adoption of a Wildland-Urban Interface map and a WUI code. Staff member Norm and other city staff said the rulemaking is still incomplete but noted an imminent timeline and potential December adoption deadline for local implementation steps.
Norm said the rules focus in part on fee schedules and building requirements for properties within designated WUI areas and warned of possible requirements that could increase building costs, such as more fire-resistant siding. "It could require things like concrete board siding," Norm said, expressing concern those requirements could conflict with efforts to maintain housing affordability and could affect existing development agreements. He asked staff to analyze how the changes might affect executed development agreements and long-term projects.
The city will hold additional staff briefings and a council work session on Nov. 18. Norm and other staff encouraged council members to attend state and regional public meetings on the proposed rules and to review the materials that staff are assembling.
Council members noted the rules may be more applicable in Wasatch or Summit counties and questioned whether applying the same standards to irrigated valley properties makes sense. Staff said more information would be provided to council members and the public as rulemaking details arrive.
