"If we vote tonight and we allow you to stay open till 11:00, that will set a precedent for other tire shops all over the city," Robinson said, noting the broader policy concern about replicating late hours for automotive uses across wards.
Property owner representatives and the applicant said the business has operated in the area for years and serves a clientele that often follows the owner between locations. An applicant representative said the business was open at various late hours historically to serve customers and described the service as providing emergency assistance to stranded motorists. One applicant representative said the move from a burned location at 1200 East Broadway would consolidate operations; he stated the intent was to cease operation at the burned site if the new permit were approved.
Council members examined alternatives on the floor. Robinson proposed a 9 p.m. closing time; other council members suggested 8 or 10 p.m. After amendment and a roll-call voice vote, the council approved the conditional-use ordinance as amended to set closing at 9:00 p.m. The emergency clause was also invoked.
Council members said they opposed setting an 11 p.m. precedent for such automotive uses because it could encourage multiple similar late-night operations along East Broadway. The applicant agreed to the amended closing time during the meeting.
The ordinance as adopted recognizes the existing business pattern while limiting evening hours to address neighborhood concerns. City staff and code enforcement will monitor compliance and the council indicated they expect the neighborhood and business to adhere to the new hours.
