Garden City adopts Ordinance 25-03 to update condominium plat and design rules

The Garden City Town Council approved Ordinance 25-03 on Oct. 9, 2025, amending Chapter 11E-524 of the Garden City Municipal Code to add and clarify requirements for condominium subdivisions. The ordinance updates preliminary- and final-plat procedures, specifies the handling of garages and storage areas, requires provision for maintenance facilities, and sets standards for dedicated open space.
Under the revised ordinance, developers must submit proposed bylaws and condominium declarations (CC&Rs) with the preliminary plat application and must provide for control and maintenance of open and common areas. The final plat may not be signed by the mayor or recorded until the condominium has received an approved life-safety inspection of the building shell, blueprints and all open areas from the Garden City Building Official, and until the subdivider has submitted final bylaws and condominium declarations. The final bylaws and declarations must be approved by the Council and filed with the Rich County Recorder, including the instrument number(s) under which each document was recorded.
The ordinance requires that all garages be designated on the preliminary and final plat and on deeds as part of the particular condominium unit and states explicitly that no garage may be condominiumized or sold separately from its condominium unit. It also requires adequate storage areas for residential condominiums to store boats, campers and trailers, and adequate interior storage space for residents' personal property.
Section F requires a maintenance building or room of adequate size and location to store maintenance equipment and supplies for common areas. Section G requires dedication of usable open space, placement of building sites and common areas to maximize privacy and solar access, and a plan ensuring perpetual maintenance of that open space. Section H confirms that all other applicable town ordinances, rules and regulations, and any other governmental entities with jurisdiction, must be complied with by condominium subdivisions.
The ordinance includes a standard severability clause stating that if any provision is held invalid, the remainder remains effective. The document is headed "Ordinance #25-03" and cites prior municipal ordinances (11E-524, 11E-400 and 11E-500) and the Utah Code as the statutory basis for treating condominiums under local regulations.
The adoption block is signed by Mike Leonhardt, Mayor, and Cathie Rasmussen, Town Clerk.
