The Cody City Council on Nov. 6 approved an application from Cody Craft Brewing LLC for a winery permit for a property at 1732 Sheridan Avenue, but staff said the city will withhold final issuance until the applicant provides a federal Alcohol and Tobacco Tax and Trade Bureau (TTB) permit that is delayed by a federal shutdown.
Cindy Baker, city staff and the clerk’s office reference for the item, told the council that the state liquor division had cleared the application but “the only item that has not been received at this point is the federal TV [TTB] ... and due to the fact there is a federal shutdown, there is a delay in obtaining this permit. However, the government money can approve this, and I would hold issuance continued upon receipt of that document.”
No members of the public spoke during the public hearing on the permit. After staff presentation and brief council questions about the licensing process, Council Member Sedneri moved to approve the application; Council Member Shreve seconded the motion and the council voted to approve the permit.
The council’s action authorizes the city-level approval of the winery permit application; Baker’s statement establishes that the city will not issue a final, operational permit until the applicant supplies the outstanding federal document. The city record and the state liquor division raised no other objections during review, Baker said.
The council took no separate action to change the city’s conditions for issuance beyond Baker’s recommendation to hold issuance pending the federal permit. The timeline for the TTB document was described as uncertain because of a federal shutdown; no specific date was provided.
