County counsel reviewed recorded covenants presented to the board and reported that earlier covenants filed in 1994 included the property but a 2005 filing removed Ron Mitchell's parcel; counsel advised the board that enforcement of deed covenants is a matter between property owners and is separate from the county's zoning authority.
After staff and legal clarification, a motion to approve the rezoning passed on voice vote; Commissioners recorded "aye." The board did not open a new public hearing because a public hearing had been held previously.
