Proposed zoning for residential substance‑abuse treatment centers tabled for DA review

WAGONER COUNTY, Okla. — A proposed amendment to Wagoner County's zoning code to add "residential substance abuse treatment centers" as a conditional use was tabled on Nov. 3 so the district attorney's office can review statutory notice and other legal language.
Casey Sanders of planning and zoning presented the draft ordinance language and said the staff defined the use as a community‑based residential facility that provides diagnostics, therapeutic services, counseling, treatment and long‑term room and board for persons receiving active alcoholism or drug‑abuse treatment. Sanders said the draft excludes hospitals, transient lodging, hotels and motels.
Staff included a separation requirement to avoid overconcentration: treatment centers would have to be at least 2,640 feet apart as measured in a straight line from lot line to lot line, and per "Oklahoma State statute" such facilities must use a quarter‑mailing notice rather than a standard 300‑foot notice for zoning actions. "I have not" had DA review, Leah Messner of the district attorney's office told the board when asked; Commissioner James moved to table the item to allow that review.
A facility operator present, Brian Day, said he would return next week to answer any technical questions. The board asked planning and zoning to submit the draft to the DA and return the item at a later meeting.
