Clerk’s reading of the file cited the relevant standards for altering preexisting nonconforming structures and referenced Massachusetts General Laws Chapter 40, Section 6, which requires the permit‑granting authority to find that any change will not be substantially more detrimental to the neighborhood.
Petitioner Mario De Leon said he and his family recently purchased the house and want to add dormers to make the third‑floor rooms usable for a large household. “We just bought the house to live comfortable,” De Leon said, describing the existing sloped ceilings as uncomfortable and noting relatives will help with the mortgage and live in the home periodically.
Board members asked whether the flat dormer roof would raise the roofline and whether the new roof height would exceed the ordinance maximum. De Leon and the designer confirmed the plan’s intent is a modest change: the proposed roofline is within the 35‑foot maximum but does increase roof profile within existing setbacks. The petitioner also confirmed the house is unoccupied now and will be renovated before anyone moves in.
The board discussed setbacks and roofline measurement and reviewed whether the dormers would be ‘substantially more detrimental’ under M.G.L. Chapter 40, Section 6. No members of the public spoke in favor or opposition.
A motion to grant the special permit carried on a roll‑call vote. The board included standard expectations that projects comply with building‑permit, fire‑prevention and inspection requirements before occupancy.
