Under current law, nomination papers for the spring election may be circulated beginning on Dec. 1 preceding the election; filing deadlines generally remain unchanged under the bill, with nomination papers normally required to be filed no later than 5 p.m. on the first Tuesday in January preceding the election. The spring election is the election held on the first Tuesday in April to elect nonpartisan judicial, educational and local officers, and it also includes the presidential preference primary when scheduled.
The billtext replaces references to "Dec. 1" with "Nov. 16" in a chain of statutes that govern when papers may be circulated and when related procedural steps must occur. Sections of the statutes amended or updated in the bill include: 8.05 (selection of municipal nominees/caucus rules), 8.10 (nomination paper circulation and filing for spring election), 8.11 (village primary petitions), 8.50 (judicial vacancy timing), 11.1111 (voting period language), 17.21 (county officer vacancy and special election timing), 17.245 (new municipal office filling), 17.25 (town supervisor special election timing) and 59.10 (county board vacancies). The Legislative Reference Bureauanalysis in the bill packet states the change is intended to move the "first date on which nomination papers may be circulated" to the earlier November date and to make conforming changes in other provisions that track that date.
Practically, the change would allow candidates or supporters to begin collecting signatures and circulating nomination papers earlier in the calendar year while leaving the standard filing deadline (5 p.m. on the first Tuesday in January) as stated in current law. Other timing provisions that reference the Dec. 1 cutoff for special election scheduling and judicial vacancy timing are likewise adjusted in the bill text to use Nov. 16.
