A Yukon governing board voted to postpone consideration of a variance for an accessory structure at 908 Travertine Court Circle after the applicant's attorney requested the hearing be heard before a full board.
The board read the agenda item into the record as a request by Kevin Lang for a variance from the Unified Development Code (Chapter 2-15, Article 3, Section 2-15-306), relating to accessory structures and required setbacks for buildings taller than 10 feet.
Mike Sigler, an attorney representing Kevin Lang and his wife, asked the board to continue the item to the next meeting so all members could be present. Sigler said that, historically, when a case required a unanimous vote and not all board members were present, applicants had the option to wait for a full board. He asked for the same accommodation in this case.
The board took a motion to postpone the hearing until the next meeting with a full board present. On a roll-call vote, Vice Chairman Kenneth Floyd, member Stacy Carpenter and member Schaller voted yes; the motion carried 3-0. The meeting record does not identify a mover or seconder for the motion.
Before that item, the board voted to approve the minutes from the May 5 meeting on a roll-call vote with the same three members voting yes. There were no public comments and no new business; the meeting then adjourned.
"We don't do this as an intent to delay or prolong anything. We've been at it for a number of months. And so, we appreciate the consideration," Sigler said after the vote, referring to the decision to seek a hearing before a full board.
The variance request will be placed on the agenda for the next meeting when the board expects full membership to be present. The Unified Development Code sections cited in the record govern accessory structures, including height limits and additional setback requirements when structures exceed 10 feet in height.
