Christian County Commission denies petition to vacate portion of Holder Road after contested hearing

The Christian County Commission voted unanimously to deny a petition to vacate a portion of Holder Road after a public hearing that included testimony from the petitioners, dozens of residents and multiple emergency-service agencies.

Petitioners Patricia Hobbs and Susan Spence told the commission the portion of Holder Road they seek to vacate has become a hazardous cut-through and an unreasonable maintenance burden. "Holder Road is not just a road. It is my home of nearly 55 years," Hobbs said, summarizing the petitioners' case that traffic volumes — they cited counts near 1,700 vehicles per day — and repeated damage to private property show the segment is "practically useless" as a public utility and imposes an unreasonable financial burden on the county.

Opponents, including residents, farm operators and local officials, urged the commission to keep the road open, saying it is a longstanding public asset that supports emergency response, school buses, businesses and farm deliveries. "This is democracy at work," Mike Bridges, who represented the remonstrators, told commissioners as he opened the opposition's presentation.

Public-safety officials strongly opposed the vacation. Sheriff Brad Cole said the county has increased patrols on Holder Road and provided recent statistics, adding that closure would lengthen some response times substantially: "Holder Road has received more patrol and more attention from the Sheriff's Office than any other County Road in the County, period." Nixa and Clever fire chiefs, Republic Fire Department and Cox Health EMS representatives testified that Holder Road provides a faster route for mutual-aid responses and that gates or restricted access could delay life-saving responses.

Both sides introduced engineering and traffic evidence. Petitioners relied on a traffic analysis and cited cost estimates for needed upgrades on the petitioned portion (they listed paving and related work totaling about $61,700 for the affected parcels) and argued the county could avoid long-term maintenance costs by vacating the segment. Opponents and several speakers cited an Olsen safety audit and said recommended countermeasures and a pending FEMA hazard-mitigation grant for the low-water crossing could address many safety concerns without vacating public access.

Commissioners framed the action as a legal test under Missouri law: the petitioners must show the segment is unused or that continued maintenance would be an unreasonable burden, a standard the county read from Missouri Revised Statute 228.110 at the hearing. After considering testimony, exhibits and questions from commissioners, Presiding Commissioner Lynn Morris said he did not find the petitioners had met that burden and moved to deny the petition. The motion passed on a roll-call vote: Western Commissioner Johnny Williams — aye; Eastern Commissioner Bradley Jackson — aye; Presiding Commissioner Lynn Morris — aye.

The commission also voted to instruct the county counselor to draft an order of findings reflecting the decision. Commissioners and county staff said planned road work — including an overlay, new striping and signage — and ongoing FEMA hazard-mitigation work on the low-water crossing remain on the county schedule but were temporarily moved pending the hearing outcome.

The hearing record included 19 exhibits submitted by the petitioners, remonstrance exhibits and the Olsen safety study. The county preserved the public record and closed testimony before the motion. The commission concluded the hearing and said the drafted findings would be presented for their consideration when complete.
