Todd Weiler, chair of the Judicial Confirmation Committee, opened the meeting and confirmed a quorum, saying Sen. Ipsen was present in person and Sens. Brammer and Kwan were online. Sen. Ipsen moved that the committee go into a closed session; a second was not recorded in the public transcript.
Weiler cited "sections 204 and 205 of the Open and Public Meetings Act" as the legal basis for closing the meeting, and said the committee anticipated the closed portion would take about 10 minutes, after which the public hearing would resume. When Weiler called for the vote members responded "Aye." The chair declared the motion passed unanimously; the transcript shows the chair first saying the motion "passes 5 to 0" and shortly after saying "6 to 0," a discrepancy noted in the public record.
The motion authorized the committee to hold a private session during which the appointee would be invited into the room to answer questions under oath. No other motions, directions to staff or substantive debate were recorded in the public portion of the transcript.
