IDA approves waiver to 70% local labor requirement for Horseheads metal-building erector

The Chemung County Industrial Development Agency granted a waiver on Oct. 8 allowing an out-of-area erector to perform pre-engineered metal building erection for a Horseheads industrial project after a review of bids and a due-diligence report.
Kevin Lokey of Lokey Grill, the firm contracted by the IDA to monitor local labor compliance, told the board the waiver application came from Horace Edge Real Property LLC for work at 120 Ryanair Road in Horseheads. The general contractor, Edger Enterprises, solicited bids for the erection and related metal roofing and siding; Lokey said the only bid meeting the full scope and schedule came from an erector based in Clyde in Wayne County (identified in the submittal as Ann Martin). Lokey reported local bids were about 44% higher and that the out-of-area erector did not employ local labor on the crew but was the only bidder able to provide the complete scope within a four-month schedule that kept the project on track.
Lokey described the IDA's waiver categories (warranty issues, specialized construction, significant cost differentials, no local labor available and other compelling circumstances) and said the application was submitted under specialized construction, price differential and other compelling circumstances. Lokey said his office performed the monitoring due diligence, reviewed bids and recommended approval of the waiver. The board moved to approve the waiver; the motion carried by voice vote.
