Public Safety told the committee that a background check showed an OWI conviction within two years of Gay's application and an additional possession conviction that the applicant did not list on the application. "The basic... the one with the OWI conviction, unfortunately, done within that 2 year time frame of his application is really what's kind of the damaging part here," the Chief said during the packet review.
Gay told the committee he had been charged in August 2024 with possession of THC and OWI; he said two charges were later dropped and that he is enrolled in classes at NWTC. "Back in 2024, August, I got pulled over and charged with possession of THC, OWI, and operating with a controlled substance," Gay said as he described the proceedings. Gay's father, Tim Gay, spoke in his support and described his son's work schedule and character.
Committee members noted the village follows a strict policy and said consistent application was a deciding factor. "We have some very strict rules that we follow here in Ashwaubenon," Chairperson Paul said during deliberations. The committee voted to uphold the denial; the chair told Gay he could present additional evidence and ask the full Village Board to review the case on Jan. 22.
Committee members suggested materials that could help an appeal, such as a letter from Mr. Gay's manager attesting to reliability or documentation showing completion of rehabilitation or diversion conditions. The committee did not approve the operator's license at this meeting.
Procedure and next steps: the committee's action upholds the administrative denial and does not grant any license; Mr. Gay was directed to the Jan. 22 Village Board meeting to present supplemental documentation if he wishes to pursue an appeal.
