Georgia House approves cleanup and timing changes to homestead-exemption law

The Georgia House on Feb. 18 approved House Bill 92, a cleanup measure intended to clarify implementation of the homestead-exemption law previously enacted as HB 581.
Representative Blackman said HB 92 aims to provide technical fixes and additional time for local governments to respond. Key changes outlined on the floor include adding a 5-acre area definition consistent with other statutes; clarifying notice timing and the process if local governments do not provide an estimated rollback rate; permitting filing for an exemption during an appeal process; allowing a surviving spouse to retain a homestead exemption without re-filing; and extending the local opt-out period to March 31.
Blackman told members the bill was not intended to advantage tax collectors but to give taxpayers more clarity and protection. Several members asked clarifying questions about the extension and the potential local effects; the sponsor and questioners characterized the changes as cleanup and an extension of time for local officials to act.
The House adopted the rules committee substitute and passed HB 92 by recorded vote, yeas 173 and nays 1. The body then ordered immediate transmission of the bill to the Senate.
