Members reviewed the status of the proposed donation of the InsaneCycle sculpture and agreed to press for clarity from the donor while documenting legal sticking points.
CPAC members said roughly $10,000 in CPAC 1% funds has been earmarked for moving and installing the piece in Carbondale, but progress has stalled because the donor and the town attorney have not agreed on contract language. Staff reported that the town attorney prepared a simplified donation contract and that the donor (referred to as Nancy in the minutes) has repeatedly returned her own reworked version. Staff said several donor-supplied provisions were legally unacceptable to the town.
Commissioners agreed that staff should assemble a bullet-point list of the specific sticking points and present that list at the December meeting. If the issues are resolvable the commission indicated it would pursue further direct outreach; if not, members agreed it would be appropriate to close the file so the donor could consider other placement options.
Town staff indicated the ball has been in the donor’s court for a number of months and recommended a single further outreach before stepping back. The commission discussed internal deadlines (options suggested included Dec. 31 or Jan. 31) and asked staff to propose a timeline and record of attempts to contact the donor.
