Culpeper council approves resolution requesting VDOT convey right-of-way behind Kestner Wayside

Council considered a staff request to send a formal resolution to the Virginia Department of Transportation asking VDOT to release a dedicated right-of-way behind Kestner Wayside so that the town could contemplate a potential land swap tied to a by-right development proposal.
Andrew (town staff) said the parcel is currently part of dedicated right-of-way and that a developer had proposed a by-right project that could include a land swap providing additional recreational amenities. Staff told council that, in February, council had directed staff to contact VDOT and that VDOT had requested a formal resolution from town council asking the commonwealth to release the right-of-way so it could be conveyed to the town.
When asked whether approving the resolution would choose one of the development proposals, Andrew replied it would not: "That will be determined later on. Essentially, this request is simply to start the process with VDOT for the right of way to be conveyed to the town," he said. The resolution authorizes the town to request conveyance but does not dispose of the land or adopt any particular development plan.
Council member Short moved to approve the resolution. The clerk called the roll; Council member Brown, Council member Olinger, Mayor Reeves, Council member Amicus, Council member Russell, Council member Schmidt, Council member Short and the Vice Mayor all voted "Aye". The motion carried.
Next steps: staff will continue the conveyance process with VDOT and, if the right-of-way is conveyed, the town will later consider disposition or park improvements and any developer proposals.
