During deliberations a commissioner moved that the board find the owner had demonstrated the requisite special circumstances not created by the owner, that the spirit of the ordinance would be preserved, and that granting the variance would not alter the essential character of the neighborhood. The motion was seconded and the roll call showed the required votes for approval; the chair announced the motion passed.
The variance is limited to the separations described in the application and does not authorize any use beyond what is allowed in the zoning district. Staff noted no adverse comments were filed by the neighborhood association and recommended conditions remain as presented.
