Town staff previewed a conditional rezoning application from applicant Thomas and Hutton and said the application includes a proposed Mallory Creek master land-use plan amendment and will be the subject of a public hearing at the regular council meeting on Thursday.
Staff said the presentation will include the difference between a general and a conditional rezoning, a vicinity map, parcel size and current versus proposed zoning, a site tree survey, proposed density compared with adjacent neighborhoods, and a list of public and HOA meetings the applicant has held. Staff specifically noted the applicant conducted a community and HOA meeting on Jan. 28 and that staff and council attended community meetings to confirm the consistency of materials presented to the public and the council.
The presenter emphasized that some commitments the applicant has offered are voluntary conditions associated with a conditional rezoning; those items would not be required under by-right development. Staff said some of the proposed site features represent conditions that the developer has agreed to accept as part of a conditional rezoning rather than standard ordinance requirements.
The presentation also includes trip-generation analysis, a tree-survey report, and staff's assessment of how the project aligns and that which it does not align with the Leland 2045 strategies and future land-use guidance. Staff said the planning board reviewed the item in December and that the applicant's updated slides were pending at the time of the briefing.
Why this matters: a conditional rezoning can secure legally binding conditions negotiated as part of a rezoning approval; staff flagged that the town's conditional-rezoning process is the vehicle residents and the council may use to obtain commitments from a developer that are not available through by-right approvals.
