Nibley planning commission hears rezoning request for 5.2-acre parcel; staff recommends denial

The Nibley City Planning Commission on Feb. 6 held a public hearing on Ordinance 25-7, a proposal to amend city code 19.12.40 and to rezone about 5.2 acres of parcels 3227002 and 3227001 (approximately 1425 West 2600 South) from commercial to the mixed-residential (RM) zone. Levi Roberts, Nibley city planner, summarized the applicant’s concept plan and recent parcel history and said "it is staff's recommendation to deny" the ordinances.
Roberts told the commission the applicant intends the rezoned area to extend an existing townhome development to the east and that the parcel had been rezoned to commercial in June 2023. He noted infrastructure considerations, including that Heritage Drive would need to be constructed and coordinated with the previously approved commercial concept plan and a developer-led public infrastructure financing (TIF) approach.
A representative for the applicant said the preliminary plat is in process and that coordination between the proponent, city council and staff was ongoing; the speaker said some outstanding information could be resolved in a week or two. Dirk Howard, a nearby property owner, urged the commission to keep the area commercial and light-industrial, saying the Heritage Drive corridor and vehicle impacts made commercial uses the best fit.
Before the hearing, the commission voted to amend the agenda to remove items 2 and 4 for further council/staff coordination; the motion passed 5–0. The public hearing on Ordinance 25-7 was held and public comment was taken, but the transcript does not record a final commission vote on Ordinance 25-7 itself at this meeting.
No formal approval of the rezoning was recorded in the hearing. The record shows staff recommended denial and that commissioners asked staff to continue coordination and return with additional information where needed.
The commission will consider any formal recommendation or ordinance action at a future meeting if and when the item is reintroduced.
