Panel rejects accessory-dwelling unit at San Lorenzo property; denies height variance

The Dallas Board of Adjustment on Jan. 21 denied a request to construct and maintain an accessory dwelling unit (ADU) at 10115 San Lorenzo Avenue and also denied a variance to allow the proposed structure to exceed the district’s height limit.
Applicant Monica Hernandez said the ADU was intended to house the homeowner’s adult daughter to assist a homeowner with Parkinson’s. The proposal showed a tiny home located about 64 feet behind the principal dwelling with a loft-style sleeping area, an accompanying new garage and alley access for parking. Hernandez said the applicant conducted neighborhood outreach and submitted one supporting letter from a neighbor.
Board members questioned visibility from San Lorenzo, the ADU’s placement on the lot and whether ADUs of this type were common in the neighborhood; the applicant did not provide photographic evidence of comparable ADUs. Several members expressed concern that the application did not meet the board’s standards for not adversely affecting neighboring properties or for avoiding self-created hardship. One board member said deed-restricting the lot to prohibit rental would help but was not sufficient to overcome other concerns.
An initial motion to grant the ADU failed on a 3-2 vote. The board then voted 5-0 to deny the ADU request without prejudice so the applicant may revise plans and return. The board also denied without prejudice a requested variance to the building-height regulation. The board administrator will mail formal notices to the applicant.
