Council advances first reading to reinstate attorney requirement for municipal court judge
Summary
Council received first reading of Ordinance No. 15-36 to restore a municipal code requirement that the municipal court judge be a licensed attorney in Wisconsin; no final action was taken and the matter returns for second reading Nov. 11.
City Administrator Steve Barr told the Marshfield Common Council on Oct. 28 that city code language requiring the municipal court judge be licensed to practice law in Wisconsin was inadvertently removed in earlier code revisions when the joint municipal court expanded to include Stratford and Spencer.
Barr said the change was unintentional and that the current proposal — Ordinance No. 15-36 — would reinsert the requirement that the municipal court judge be a licensed attorney. He said Judge Cruz’s term expires April 30, 2027, and that candidacy paperwork will not be available until roughly a year before the election; the ordinance would be forwarded to Stratford and Spencer if approved by the council before the election cycle.
Barr said staff recommended no final action at the first reading and that the council should consider final adoption at the Nov. 11 meeting as a second reading.
No vote on final adoption was held Oct. 28; the council will consider the ordinance again on Nov. 11.
