Board approves five encroachment and modification petitions to allow subdivision, commercial and transit work

The Indianapolis Board of Public Works on Aug. 13 unanimously approved five separate resolutions allowing encroachments into regulated-drain rights of way, actions that DPW staff said are consistent with maintaining expected drain flows.
DPW Stormwater Program Manager Natalie Stephen told the board the petitions included two filings from Lennar Homes of Indiana LLC for the Crescent Ridge subdivision, a petition from AeroGas Inc. to modify the Fowler Hausen regulated drain to expand a detention basin, a petition from Steve Jones to encroach into the Miller Ditch regulated drain for a tractor sales and service facility, and a petition from the Indianapolis Public Transportation Corporation (IndyGo) to modify the Smith Young regulated drain at the Blue Line terminus to accommodate bus circulation and staff parking.
"DPW staff reviewed [each] petition ... and found that the submitted calculations and plans indicate the proposed improvements are acceptable for the expected flows of the regulated drain," Stephen said. For the IndyGo submittal, she said the request includes a reduced regulated-right-of-way width of 20 feet to exclude new storm-sewer and detention infrastructure owned and maintained by IndyGo.
The board approved each petition by voice vote with no members recorded as opposed. Motions and seconds were recorded in the meeting record for each resolution: resolution No. 9 (Lennar Homes — Schilling regulated drain) was moved by Robert Perron and seconded by Leslie Schulte; resolution No. 11 (AeroGas — Fowler Hausen) was moved by a board member and seconded by Susie Corte; resolution No. 12 (Steve Jones — Miller Ditch) was moved by Robert Perron and seconded by Idris Redmond; resolution No. 13 (Indianapolis Public Transportation Corporation/IndyGo — Smith Young) was moved by Leslie Schulte and seconded by Robert Perron; and resolution No. 14 (Lennar Homes — Raubhorn regulated drain) was moved by Susie Corte and seconded by Idris Redmond. For each item DPW recommended approval based on technical review, and the board approved the staff recommendations.
Why it matters: Encroachments and right-of-way modifications can allow development and public infrastructure projects to proceed while preserving drainage function when projects are designed and reviewed to meet hydraulic expectations. In these items, DPW staff stated that the petitioner-submitted plans and calculations supported continued, unaffected operation of the regulated drains.
The board did not allocate additional funding or set implementation dates in the resolutions; approvals grant permission to proceed with the proposed improvements subject to any conditions in each petition.
