The Muskego City Planning Commission voted on Nov. 4, 2025 to recommend that the Common Council amend the zoning map for two lots on Enterprise Drive (South 84 West 19120 Enterprise Drive and the adjacent vacant lot) from M-2 to a planned development district to permit a waiver of the rear setback that would make an existing building compliant and allow an expansion.
A staff member explained the rezoning request (Resolution PC0512025) arises because the original building was constructed "a few inches too close to the northern lot line," which makes the existing structure noncompliant. The developer and property owner seek a planned development zoning that keeps the base M-2 district but allows a waiver for the rear offset. The applicant is requesting the planned development to permit a 14‑foot rear offset so the building is compliant and expansion can proceed without the financial limits that would apply to nonconforming structures.
"They're not asking for any kind of density bonuses or any other kind of waivers or bonuses as part of this," the staff member said, describing the request as limited to the rear offset waiver. The staff member also noted the rezoning is contingent upon combining the lots and subsequent building approval through the standard permit process.
Commissioner Bartlett declared an abstention because his firm is handling the work on the project. The commission called the vote and the motion to recommend the rezoning passed with three votes in favor and one abstention.
The recommendation will go to the Common Council for final action; no public questions were recorded at the Planning Commission meeting on this item.
