Developer asks council to place expired Elam Valley reimbursement agreement on Jan. 16 agenda

Robinson said the developer discovered the agreement’s expiration while preparing to sell some impact‑fee certificates to home builders and requested that the matter be placed on the council’s Jan. 16 agenda to provide historical context and to seek permission to pursue an extension between the parties.
Council and staff clarified the city’s agenda rules: items may be placed on the council agenda by the mayor, by recommendation from an advisory board, or by two council members requesting placement. The mayor and council did not make a substantive decision at the meeting; the mayor said staff will inform Robinson if at least two council members request the item for the Jan. 16 agenda.
Robinson said the vouchers themselves do not list an expiration date, but the underlying reimbursement agreement contains a 15‑year expiration provision. He said litigation and other historical events limited the developer’s ability to act earlier. No council action was taken at the meeting; the request was for agenda placement and further council consideration.
