TCEQ adopts enforcement package, remands one order for clarification; monthly enforcement report reviewed

The Texas Commission on Environmental Quality approved a package of enforcement orders during its Jan. 30 meeting, with the exception of one order that the commission remanded for additional development and clarification.
Enforcement Division staff presented items 8 through 22 as a grouped package and reported assessed administrative penalties totaling $351,294 for the reported items, with $40,116 deferred, $58,781 applied to supplemental environmental projects and the balance to general revenue. The commission moved to adopt items 8 through 14 and 16 through 22 as recommended by staff.
Commissioners questioned item 15: the draft order included an immediate requirement to cease discharging sand waste from a sand‑settling tank and a separate provision that allowed 180 days to begin capturing or addressing the sand waste. Commissioners said the two provisions could appear to conflict in practice and asked staff to clarify how both requirements would operate in tandem. Enforcement staff said the timing reflected agreed corrective-action timelines and that respondents typically commit to immediate cessation and then pursue repair/replacement or other remedies within an agreed period; commissioners expressed concern about enforceability and remanded item 15 to the executive director for further case development and clarity.
Separately, Enforcement Division staff presented the monthly enforcement report through November of fiscal year 2025: 216 effective administrative orders issued (20 containing supplemental environmental projects), assessed penalties totaling $2,391,563 and 3,795 notices of violation issued. The report also detailed pending orders, backlog counts and cases at the Attorney General’s Office. Commissioners thanked staff and discussed backlog trends and staffing.
