Las Cruces board unanimously authorizes legal strategy, potential settlement in special-education case

The Las Cruces Public Schools Board on Feb. 18 unanimously authorized legal counsel and the superintendent to proceed with legal strategy '1 including potential settlement '1 in a special-education due-process matter styled Student v. Las Cruces Public Schools (DPH 24-25-18).
The board had met in closed executive session earlier the same day to discuss personnel matters, investigations of classified and certified employees, personally identifiable student information and "pending or threatened litigation" permitted under the New Mexico Open Meetings Act (Section 10-15-1(H)7). President Court reported the session and identified the due-process complaint by case style.
Following the closed session the board considered a motion to authorize legal counsel and the superintendent to implement the legal strategy discussed in executive session, including settlement negotiations if appropriate. The motion was made by Vice President Nolan and seconded by Member Frank. Secretary Wofford recorded the unanimous roll-call vote in favor of the authorization.
Ending: The board's action permits counsel and district leadership to take the next steps in resolving the pending special-education due-process matter; the district did not disclose legal strategy or settlement terms in open session.
