She cited the Fifth and Fourteenth Amendments and referenced federal court cases (Zadvydas v. Davis and Plyler v. Doe) in support of the claim that constitutional protections extend to noncitizens on U.S. soil.
Elkins said she could provide a link to Hays County’s resolution after the meeting and urged the council to adopt a similar measure, saying it would be “a patriotic act of fidelity” to the Constitution. The council did not take formal action on the suggestion during the meeting; staff will forward the comment to appropriate departments for consideration.
