The Public Works committee approved a resident’s request to reconstruct a fence and attached deck that sit within the city right‑of‑way at 2824 Sixteenth Place South, subject to an indemnification agreement.
Applicant Lori Zielinski said the fence and deck existed for years and were damaged in a recent storm. A survey she provided showed the fence line encroaches into city right‑of‑way. Staff asked for an updated survey and the committee reviewed photos and the parcel layout. Committee members and staff confirmed the property line and discussed the need for the applicant to hold the city harmless for future maintenance and liabilities in the right‑of‑way.
Councilor Sims moved approval conditioned on a proper indemnification agreement; Councilor Nelms seconded and the motion carried unanimously. The clerk’s office will record the agreement and conditions before work proceeds.
