The Area Plan Commission on Nov. 6 approved several subdivision matters on its agenda.
Herman Acres (MAJ‑2025‑004), a four‑lot subdivision south of West Diamond Avenue, was presented by staff. The county engineer and MPO raised no objections, and staff recommended primary plat approval with standard conditions. Petitioners Michael Ward and Tom Herman said the replat is intended to resolve an inheritance/ownership situation and that no new structures are planned immediately.
After discussion and a roll call, the commission recommended primary plat approval with the conditions listed in the staff report. During the same agenda item the applicant requested a complete sidewalk waiver; the commission voted to approve that waiver by roll call (7 yes, 1 no, 1 abstention). Commissioners recorded concerns and conditions to be satisfied prior to recording the plat, including completing the sidewalk waiver statement if the waiver was approved; if the waiver were not approved, sidewalks would be required before recording.
Separately, the commission approved two one‑year extensions: MIN‑2024‑029 (Richie Acres, 15245 Cemetery Road) to record the subdivision, and MIN‑2019‑049 (Sheffer's Side Road) to complete basic improvements. Petitioners said the Sheffer's Side Road extension was requested so the owner could determine the final cul‑de‑sac location before completing construction. Both extensions passed on roll call votes recorded as nine votes in favor and none opposed.
The commission’s actions on the plat and extensions are approvals or recommendations required under the local subdivision control ordinance and will proceed according to standard recording and inspection procedures.
