Board grants continuance for Anita Biricel McQuigg after counsel scheduling conflict

The Board of Pharmacy Disciplinary Petition Committee voted unanimously Dec. 18 to grant a continuance requested by petitioner Anita Biricel McQuigg after her counsel reported a scheduling conflict.
The continuance motion was made by Seung Oh and seconded by Nicole Lyle. Deputy Attorney General Nicole Trauma advised the committee that McQuigg’s attorney was engaged in another hearing and had filed a request for continuance. Chair Nicole Thiebaud opened the matter for public comment; no members of the public spoke on the motion.
At roll call all members present voted yes: Jay Newell, Seung Oh, Satinder Sandhu, Maria Serpa and Chair Nicole Thiebaud. The motion passed and Administrative Law Judge Patrice Huber announced on the record that the case (agency case number 6992; OAH case number 2024120325) would be continued to a date and time to be determined. The hearing record was closed for that matter at the time of continuance.
The continuance was procedural; no findings were made about the merits of the petition. The committee will place the matter on a future agenda and inform the parties of the new hearing date via the Office of Administrative Hearings.
