State law change will expand tribal/organizational seats on Spokane Regional Health District board; county staff present two resolution options

County legal counsel briefed the Board of County Commissioners on 2024–25 state legislation that modifies the composition rules for local regional health district boards and becomes effective on July 27, 2025. Counsel said the statutory change permits each federally recognized tribe and qualifying organization to appoint one or more members to the health district board, rather than limiting representation to a single tribal or organizational seat.

Counsel explained the practical consequence: as tribes or eligible organizations notify the health district that they intend to appoint a member, the new appointees may be added automatically to the local health district board within a 60‑day window unless the state board of health adopts rules to the contrary within a one‑year period. The statute also maintains the longstanding requirement that the number of elected officials on a health board may not exceed the number of non‑elected members; therefore, additional elected positions or non‑elected seats must be adjusted as tribal/organizational seats are added.

Counsel presented two draft sequencing options for amending the county’s health‑board resolution so the county can accommodate automatic tribal/organization appointments while preserving fiscal and representative alignment: Option 1 would reintroduce a city representative and then add county commissioners in sequence as tribal/organizational members are added; Option 2 sequences appointments through Spokane city, Spokane Valley, other cities/towns and then county commissioners. Counsel and commissioners discussed the legal ambiguity in the statute about how tribes and organizations notify the health district and whether additional local jurisdictions should be required to make financial contributions to have seats on the board.

Commissioners asked for time to review the options and said staff should place a final draft on the next legislative agenda so the board can adopt updated language; several commissioners expressed concern about maintaining fiscal alignment between those who set budget levels and those who participate on the board. No formal vote was recorded in the briefing.

Why it matters: the statutory change could substantially increase membership on the regional health district board, trigger automatic appointments, and change the board’s governance dynamics and representation; the county must amend its local resolution if it wants a predictable composition sequence when tribes or organizations opt in.
