Police urged the board to deny the special exception; the petitioner withdrew and was advised to resubmit after meeting with police, building, fire and planning staff.
Staff said the building—a three‑story structure that formerly housed a funeral home and other uses—had been the subject of repeated calls for service, including incidents after 3 a.m., underage‑party allegations, reports of a fight and at least one intoxication arrest. Assistant Chief Norman Raiford told the board officers viewed body‑cam footage showing dense crowds, parked vehicles blocking roadway traffic, and that officers were denied entry to the premises while trying to investigate. “He actually stated that they were gonna come off of the Eleventh Street Side into the main establishment. For him to sit up and put this on his mom is pretty sad. He told me that he had planned on starting these parties after 3AM,” Raiford said during testimony. He told the board APD opposed granting the special exception as presented.
Architect Jesse Wilkerson and applicant James Wilson said the back of the building contains a discrete meeting/event area and argued conditions (hours, parking control, security) could produce a lawful operation. Wilson said his mother occupies the front living quarters and denied that the back function space was the source of the reported incidents. After discussion, staff and police recommended withdrawal or continuance to allow the applicant to submit a detailed operations plan, obtain building and fire review, and meet with APD; the applicant withdrew the petition and staff offered a waiver of the re‑filing fee if the applicant re‑submits with the requested documentation.
