Planning commission reviews amendment to Liberty Estates development agreement; vote set for next meeting

Randy Hall, representing the Liberty Estates development team, presented a draft amendment to the existing Liberty Estates development agreement at a planning commission workshop and said the town attorney had reviewed the draft and found it generally in order. Hall said the change is an amendment rather than a full restatement and is intended to update cross‑references and a schedule attached to the agreement.

Hall told commissioners the requested changes include clarifying references to a color drawing in a schedule and allowing certain phases adjacent to future town road construction to be deferred until road coordination is complete. He also said the developer is proposing to split the next large build phase, Phase 8, into two parts (8a and 8b) in order to improve market timing and flexibility.

Why it matters: The amendment is procedural in part but affects how future phases are sequenced and coordinated with public infrastructure work, which could affect timing of new home deliveries and any town obligations for road construction.

Commissioners and staff said the changes appear to be minor and consistent with earlier discussions but recommended, out of an abundance of caution, that the amendment return to the planning commission and the town council for formal approval. The commission chair indicated the item will be placed back on the agenda for a vote in two weeks.

No formal vote was taken at the workshop. Staff said they will circulate the amendment package and that the item will appear on a future agenda for action.
