Board directs show-cause hearing for vape shop after Sheriff's Office alleges sale of THC products and drug paraphernalia

Community Development staff and Sheriff's Office representatives told the Board the business known as My Macias Gomez 2 LLC, doing business as My Vape and Smoke Shop at 1800 East William Street, sold devices the Sheriff's Office identified as drug paraphernalia and vapes containing THC-A on Oct. 23, 2024.
Community Development Director Hope Sullivan asked the Board to direct staff to serve a notice of and order to appear for a show-cause hearing under Carson City Municipal Code section 404.210 and to schedule the hearing for Feb. 20, 2025, not before 9 a.m. Sullivan said municipal code authorizes suspension, cancellation or revocation of a business license for "good cause," including permitting or causing unlawful activity in the operation of a business.
Sergeant Samantha Torres of the Sheriff's Office described prior outreach: in July the enforcement team visited local shops to educate owners about devices commonly used to smoke methamphetamine ("oil burners" and certain glass bongs). She said those devices have a glass stem and bulb and, based on the team's training and experience, their primary use is to smoke methamphetamine; owners were informed and several ceased sales after education. The Sheriff's Office reported that, following that outreach, investigators returned and documented alleged sales at the subject business, which led to the request for a show-cause hearing and to criminal action involving an employee.
Supervisor Giaomi asked whether other enforcement actions were underway; staff confirmed criminal charges or investigation are in process in addition to the administrative show-cause proceeding. Supervisor Schuette moved to direct staff to serve the notice and to schedule the show-cause hearing on Feb. 20, 2025; the motion was seconded and the Board voted unanimously to direct staff to proceed.
The Board did not take disciplinary action at the meeting; the scheduled hearing will provide the business owner an opportunity to appear and respond. Any appealable action (suspension or revocation) would be a subsequent, separate Board decision after the show-cause hearing.
